LGPD
The General Data Protection Law (LGPD) came into force in Brazil on September 18, with the sanction of Law 14.058 / 2020, originated from the Provisional Measure (MP) 959/20. Despite the Government having published Decree No. 10,474, from August 26, 2020, which approves the Regulatory Structure and the Statement of Positions in Commission and Trust Functions of the National Data Protection Authority (ANPD), the appointments of its members must still pass the approval of the Brazilian Federal Senate. However, companies must be focused on the LGPD already in force as far as the authorities still have the possibility to apply civil liability in cases of breach of the provisions contained in the law.
